PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, INCLUDING LIMITATIONS ON LIABILITY FOR AI-GENERATED CONTENT.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Hijaz Enterprises Inc., doing business as Bamboo Punch ("Bamboo Punch," "we," "us," or "our"), governing your access to and use of the Bamboo Punch website, platform, and services (collectively, the "Service").

1. Acceptance and Scope

By creating an account or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. The Service and AI Disclaimer

            The "Human-in-the-Loop" Requirement
            Bamboo Punch utilizes Large Language Models (LLMs) and Generative AI to assist in content creation. You acknowledge that AI technology can produce inaccurate, biased, or inappropriate information ("hallucinations"). You are solely responsible for reviewing, editing, and verifying the accuracy of all content before it is published to any social media platform.
        

Bamboo Punch provides the Service "as is" and makes no guarantees regarding the performance, accuracy, or suitability of AI-generated outputs for any specific purpose.

3. Subscription Tiers and Credit System

Our Service operates on a tiered subscription model (Trial, Grow, Advanced) and an internal credit system. By using the Service, you agree to the following:

Credit Consumption: Credits are deducted from your balance the moment an AI generation task (Image Variations, Direct Analysis, Captions, etc.) is initiated.
No Refunds for AI Outputs: Once credits are consumed, they are non-refundable, even if you are dissatisfied with the AI's creative output.
Reset Policy: Monthly credits reset at the start of each billing cycle. Unused credits do not "stack" or rollover unless explicitly stated for your specific plan in your account settings.
Trial Limits: Trial accounts are limited to one (1) social media connection and a fixed one-time credit stipend.

4. Intellectual Property Rights

Your Content: You retain all ownership rights to the content you upload to the Service and the unique "Output Content" generated by the AI for your account.

Our Tooling: Hijaz Enterprises Inc. retains all rights, title, and interest in the Service, including the "Golden Source" prompt orchestration logic, proprietary workflows, software, and brand identity.

License to Us: You grant us a limited, worldwide license to host, store, and process your content solely to provide the Service to you.

5. Social Media Platform Compliance

Bamboo Punch integrates with third-party platforms (e.g., Facebook, Instagram, LinkedIn). You agree that:

You will comply with the terms and policies of all connected platforms.
Bamboo Punch is not responsible for any account suspensions, bans, or reach restrictions imposed by third-party platforms resulting from your use of our Service.
You will not use the Service to generate or distribute spam, deceptive content, or materials that violate social media community standards.

6. Billing and Payment Agent

Bamboo Punch utilizes Stripe as its exclusive billing and payment processing agent. By subscribing to the Service, you agree to Stripe's terms and privacy policies. Hijaz Enterprises Inc. does not store or process your raw payment card information; all such data is handled securely by Stripe.

Subscription Management: All upgrades, downgrades, and cancellations are managed through the Stripe Billing Portal. It is your responsibility to manage your subscription status via this portal.

Refunds: All payments are non-refundable except as required by law or explicitly stated in a promotion. Unused credits are not refundable upon cancellation.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIJAZ ENTERPRISES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, DATA LOSS, OR REPUTATIONAL HARM RESULTING FROM AI-GENERATED CONTENT.

8. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Hijaz Enterprises Inc. is incorporated, without regard to conflict of law principles.
